They blow up too often.&#8221;"},"content":{"rendered":"<p style=\"text-align: left;\">Thus spoke Scott Udine, a talented money manager from Florida yesterday.<\/p>\n<p style=\"text-align: left;\">I had recently fallen in love with Mannkind Corporation &#8212; as had Cramer. They have a neat, new way of dispensing insulin by spray through the mouth. No needles. They need FDA approval, which is scheduled for December 29. Mannkind&#8217;s immensely successful and ultra-rich founder has dumped $920 million of his own money into the company. I&#8217;d ride on his shirt tails.<\/p>\n<p style=\"text-align: left;\">At least that was the gameplan.<\/p>\n<p style=\"text-align: left;\">The stock had been performing OK &#8212; until yesterday morning when it dropped. My stop mentality screamed, &#8220;Dump it.&#8221; I did. Instantly.<\/p>\n<p style=\"text-align: left;\">And then the doodoo hit the fan:<\/p>\n<p style=\"text-align: left;\"><a href=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/MannkindShit.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-4617\" title=\"MannkindShit\" src=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/MannkindShit.jpg\" alt=\"\" width=\"634\" height=\"252\" srcset=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/MannkindShit.jpg 634w, https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/MannkindShit-300x119.jpg 300w\" sizes=\"auto, (max-width: 634px) 100vw, 634px\" \/><\/a><\/p>\n<p style=\"text-align: left;\">What happened? The classic Cockroach event. The Classic Biotech Blowup.<\/p>\n<p style=\"text-align: left;\"><em>TheStreet<\/em> ran a story headlined, &#8220;<em>MannKind Accused of Data Fraud Coverup<\/em>,&#8221; which contained these words:<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">VALENCIA, Calif. (TheStreet) &#8212; A MannKind(MNKD_) senior manager says he uncovered potentially serious problems with clinical trials of the company&#8217;s Afrezza inhaled insulin device and accuses the company of willingly keeping the information from U.S. regulators, according to a wrongful termination lawsuit filed in September.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The MannKind senior manager, John Arditi, who filed the lawsuit against the company in New Jersey Superior Court, claims he was wrongfully fired by MannKind after internal audits he conducted in November 2009 uncovered &#8220;potential fraud and scientific misconduct&#8221; involving Afrezza clinical trial data, according to a copy of the lawsuit obtained by TheStreet.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Arditi, in his lawsuit, says he urged his superiors at MannKind to report his findings to the U.S. Food and Drug Administration but the company refused because &#8220;if the FDA was notified of these concerns, it might delay approval of MKC&#8217;s [MannKind&#8217;s] New Drug Application for Afrezza,&#8221; the lawsuit states.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The FDA is currently reviewing Afrezza and is expected to make an approval decision on Dec. 29.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Mannkind Chief Financial Officer Matthew Pfeffer, reached by phone, says Arditi&#8217;s lawsuit is without merit because the company&#8217;s investigation of the allegations conducted by an outside auditing firm found nothing wrong with the Afrezza clinical data.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The FDA has not raised any questions about the clinical data and Arditi was fired for &#8220;good cause,&#8221; Pfeffer added.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Mannkind has not submitted a copy of its internal investigation to the FDA because the company&#8217;s auditors found &#8220;nothing substantive to report to FDA. Had we found something, we would have reported it to FDA,&#8221; said Pfeffer.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">MannKind, in its most recent quarterly filing with the SEC, discloses that before Arditi filed his lawsuit on Sept. 16, the company &#8220;completed an internal investigation of his claims and retained an independent outside firm to conduct an independent investigation of his claims. Neither investigation found any basis for his claims.&#8221;<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Before being fired on May 11, Arditi was MannKind&#8217;s senior director of worldwide regulatory affairs. His lawsuit names as defendants MannKind as well as Peter Richardson, MannKind&#8217;s chief scientific officer, and Patricia Mayer, MannKind&#8217;s vice president of worldwide regulatory affairs.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">MannKind is based in Valencia, Calif. But Arditi, Richardson and Mayer worked at the company&#8217;s facility in Paramus, N.J.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Arditi claims he was fired by MannKind on the &#8220;spurious ground that he exceeded his authority in authorizing and\/or signing imaginary purchase orders,&#8221; the lawsuit states.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The lawsuit further claims that &#8220;Mayer, Richardson and MKD [MannKind] terminated Arditi&#8217;s employment due to his objection and refusal to withhold information from the FDA concerning potential safety concerns surrounding Afrezza and its clinical study data, resulting in potential fraud on the FDA and the public, in violation of law and policy.&#8221;<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The alleged Afrezza clinical data fraud and misconduct was discovered during audits of clinical trial sites in Russia and Bulgaria conducted by Ariditi, the lawsuit states.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">At one clinical trial site in Russia, for example, records showed patients with &#8220;consistent blood pressure readings&#8221; over several months, even though variations in blood pressure readings would be expected, suggesting that clinical data was not being recorded properly or even that records were being kept on fictitious patients, the lawsuit states.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">At another Afrezza clinical trial site in Bulgaria, Arditi&#8217;s audit uncovered similar data discrepancies, including records showing that patients were being treated with Afrezza when packing slips indicated that Afrezza hadn&#8217;t been delivered until weeks or months later, according to the lawsuit.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">The lawsuit doesn&#8217;t specify how many patients were enrolled at the clinical trial sites in Russia and Bulgaria. Mannkind&#8217;s clinical trial program for Afrezza included multiple phase III studies that enrolled patients across the globe, including the U.S., South America, Europe and Eastern Europe.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">MannKind CFO Pfeffer says he doesn&#8217;t know how many patients were enrolled at the Russian and Bulgarian clinical trial sites.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Mannkind has not yet filed a response to Arditi&#8217;s lawsuit with the court but Pfeffer said a response would come &#8220;reasonably soon.&#8221;<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Arditi is seeking back pay and compensatory and punitive damages from MannKind.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">Afrezza is a small, handheld device that delivers an aerosolized dose of fast-acting insulin into the lungs. MannKind is seeking Afrezza&#8217;s approval from the FDA as a treatment for adults with Type 1 and Type 2 diabetes.<\/p>\n<p style=\"padding-left: 30px; text-align: left;\">MannKind first submitted Afrezza for U.S. approval in March 2009. In March 2010, FDA rejected Afrezza and asked MannKind to submit additional clinical information about the device. MannKind resubmitted Afrezza to FDA in July 2010. Regulators are expected to make an approval decision on Dec. 29.<\/p>\n<p style=\"text-align: left;\">Now, it could be that the suit is B.S. Just a pissed-off employee trying to shake down a rich company. And Mannkind Corporation (MNKD)\u00a0 could now be a screaming bargain.<\/p>\n<p style=\"text-align: left;\">But who needs this?<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>Don&#8217;t fight the Fed. <\/strong><span style=\"color: #000000;\">Even Blind Freddie is making money in today&#8217;s stockmarket. Though the logic of the Fed&#8217;s QE (quantitative easing) makes zero economic sense, don&#8217;t fight it. <\/span><strong><br \/>\n<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">My friend Paul Lobsco is another talented money manager. This morning he emailed me<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">1) From your Wednesday column&#8230; yes, cash is always part of asset allocation, regardless of what rate one might get. I have made this point to clients countless times. To me, a good money market fund is cash. Cash equivalents are not cash, as ARPs (auction rate preferreds) taught us.<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">2) I don&#8217;t know the official numbers, but there is a ton of cash on the sidelines. With interest rates so low and the fear of a double-dip receding, much of that money is finding its way into stocks. The fear seems to changing from a double-dip to a fear of missing the rally.<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">3) Valuations are reasonable. Against the backdrop of low interest rates, better corporate balance sheets, and good earnings, stocks represent fairly good value for the investment dollar. Some stocks might prove to be quite cheap, even at today&#8217;s levels, should earnings continue to improve. I like the homebuilders and the companies that make products (like sheet rock) for homes. But there are many other sectors that trade quite well.<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">4) The global growth story appears to be accelerating. The countries with the least amount of debt burden relative to GDP have a performance advantage. One exception might be Japan, which has a lot of catching up to do (despite a huge debt load).<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">Meanwhile, we still suffer from an historic debt overhang here. Which brings me to my last point:<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">5) The Federal Reserve is like a doctor administering medicine to a sick patient. The medicine (QE2) masks the underlying disease (too much debt), but does not CURE it. The sick patient (the U.S economy) gets addicted to the medicine, perhaps getting sicker. At some point (who knows when?) the market will no longer view the fed&#8217;s role as curative. Herein lies my biggest concern and my reason for not getting too bullish. If you believe, as I do, that we cannot grow our way out of this debt burden, then the British (and others) approach may ultimately be correct: austerity and sacrifice over money-printing. When the history books are written, QE2 might be renamed &#8220;Titanic!&#8221;<\/p>\n<p style=\"padding-left: 60px; text-align: left;\">Some, like Jeremy Grantham, see it differently. Grantham, in an almost Keynesian manner, supports the easing concept. If the Fed continues on this path, we should see gold continue its strong move. I respect Grantham tremendously.<\/p>\n<p style=\"text-align: left;\">I also like gold. Look at it this year:<\/p>\n<p style=\"text-align: left;\"><a href=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/Golddoeswell.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-4631\" title=\"Golddoeswell\" src=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/Golddoeswell.jpg\" alt=\"\" width=\"631\" height=\"247\" srcset=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/Golddoeswell.jpg 631w, https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/Golddoeswell-300x117.jpg 300w\" sizes=\"auto, (max-width: 631px) 100vw, 631px\" \/><\/a><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>What an animal.<\/strong><span style=\"color: #000000;\">Apple rose strongly yesterday. There is talk now of it hitting $400 soon. <\/span><strong><br \/>\n<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong><a href=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/AppleAnimal.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-4614\" title=\"AppleAnimal\" src=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/AppleAnimal.jpg\" alt=\"\" width=\"641\" height=\"249\" srcset=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/AppleAnimal.jpg 641w, https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/AppleAnimal-300x116.jpg 300w\" sizes=\"auto, (max-width: 641px) 100vw, 641px\" \/><\/a><br \/>\n<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><span style=\"color: #000000;\">Apple&#8217;s P\/E is 21 which is low, compared with its growth and its hype. <\/span><\/span><\/p>\n<p style=\"text-align: left;\">It&#8217;s impossible to pick up any newspaper, business or computer magazine without being bombarded by yet another story extolling the brilliance of Apple&#8217;s products. There is even talk of it selling 40 million iPads next year.<\/p>\n<p style=\"text-align: left;\">In contrast, I read only two things about Microsoft:\u00a0 More bug fixes and more talk of firing Microsoft&#8217;s vision-less CEO, Steve Ballmer.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>You and I will live forever. <\/strong><\/span> I stole this slide from a Bernstein Global Wealth Management seminar. I think it&#8217;s meant to frighten us for how long we&#8217;ll all live in poverty (especially if we don&#8217;t invest with Bernstein). I found the chart energizing.<\/p>\n<p style=\"text-align: left;\"><a href=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/LivingLonger.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-4622\" title=\"LivingLonger\" src=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/LivingLonger.jpg\" alt=\"\" width=\"600\" height=\"350\" srcset=\"https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/LivingLonger.jpg 600w, https:\/\/www.technologyinvestor.com\/wp-content\/uploads\/2010\/11\/LivingLonger-300x175.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p style=\"text-align: left;\">Heck, I&#8217;ve got time for another two or three careers.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>Traveling west. <\/strong><\/span><br \/>\nI went to Portland, Oregon yesterday to see Michael and Anne, his new gorgeous wife.<\/p>\n<p style=\"text-align: left;\">Traveling is genuinely horrible. The planes are late, full of fat, sick, sneezing  people, and loaded with new charges &#8212; $99 extra for an exit row seat, $6 for DirecTV, $1.50 a sheet of toilet paper, $3\u00a0 to turn on your reading light. You get the idea.<\/p>\n<p style=\"text-align: left;\">Continental peddles $6.25 sandwiches, $8.25 grilled chicken spinach salads and other stuff that passes for food. Our Continental hostess encouraged us to choose quickly, since &#8220;<em>qualities were limited.<\/em>&#8221; I suspect they were.<\/p>\n<p style=\"text-align: left;\">Continental plane schedules 6 hours and 17 minutes for the New York-Portland trip. Flying time is only 5 hours and 12 minutes. The rest is time to be &#8220;on time,&#8221; though you&#8217;re really late.\u00a0 And they were, even beyond their cushion.<\/p>\n<p style=\"text-align: left;\">It&#8217;s truly amazing how many people can stare into blank air for hours. No book. No computer. No Kindle. No nothing. I figure 99% of the passengers didn&#8217;t spend the $6 for DirecTV. Most were turned off by the regular announcements that the hostesses couldn&#8217;t fix the busted DirecTVs, which were many.<\/p>\n<p style=\"text-align: left;\">Airports have changed. They have new gadetry. A 12-year old boy showed me how to turn the faucet on in the bathroom. A 19-year old explained the reason the boarding pass machine didn&#8217;t work for me was I already had a boarding pass. I had printed it at home.<\/p>\n<p style=\"text-align: left;\">My taxidriver used a GPS to get us to Newark Airport. But his GPS kept dying, so we read the street signs. It&#8217;s amazing. The signs point which way to go. I originally wrote &#8220;<em>they tell you which way to go.<\/em>&#8221; But they don&#8217;t. That&#8217;s reserved for the irritating lady inside my taxidriver&#8217;s GPS.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>From the Ecnomist:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">Silvio Berlusconi&#8217;s private life became news again when it emerged that the Italian prime minister had personally intervened to secure the release from police custody of a 17-year-old Moroccan showgirl. Displaying what some describe as his customary wit, Mr Berlusconi said it was better to have a fondness for pretty girls than to be gay.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>Today&#8217;s word is&#8230;.. She asked the teller, &#8220;Why it change? Yesterday, I get two hunat dolla fo yen. Today I only get hunat eighty? Why it change?&#8221;<\/p>\n<p style=\"text-align: left;\">The teller shrugged his shoulders and said, &#8220;Fluctuations.&#8221;<\/p>\n<p style=\"text-align: left;\">The Asian lady replies, &#8220;Fluc you white people too&#8221;.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #0000ff;\"><strong>Don&#8217;t mess with A.K.s (alta kakas)<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">Two businessmen in Cardiff were sitting down for a break in their soon-to-be new shop. The shop wasn&#8217;t ready, with only a few shelves set up.<\/p>\n<p style=\"text-align: left;\">One said to the other, &#8220;I bet any minute now some old fogey\u00a0 is going to walk by, put his face to the window, and ask what we&#8217;re selling.&#8221;<\/p>\n<p style=\"text-align: left;\">No sooner were the words out of his mouth when an old woman peeked through\u00a0 the window and asked, &#8220;What are you selling here?&#8221;<\/p>\n<p style=\"text-align: left;\">One of the men replied sarcastically, &#8220;We&#8217;re selling arse-holes.&#8221;<\/p>\n<p style=\"text-align: left;\">Without skipping a beat, the lovely old lady\u00a0 said, &#8220;You must be doing well.
